Terms of Service

Please note that this is a guide. As the artist, I hold the right to use my listed prices as a baseline and charge according to what you, the commissioner, are requesting. I hold the right to change or modify my prices, or this document at any time, as I see fit. By accepting a commission and sending payment, you are agreeing to the following Terms of Service and expressing that you have read, understood, and accept them.

General Information
- My work times shift drastically throughout the week due to personal obligations and other things going on in my personal life. I do not announce when I am working on commissions, but I do hold a 25+ hour work week most of the time for commissions.
- I am not obligated to work on commissions on what I deem is my ‘off-time’, unless you have paid for expedited delivery.
- Like any person, I have my own art and hobbies that I like to do on my free time, so if you see me posting other work ahead of yours, please note that it is either other commissions, or work I have done on my own time.
- Please keep in mind that my artwork is my job, and I do treat it as such. I like to be friendly and personable and hold conversations with my clients, but that does not mean I am not also expecting for you to be fair and kind in our interactions. 
- Please do not ask to contact me personally, engage me in role-play, or send me nude images, “as reference” or otherwise. This type of behavior is not okay, and may result in my removing myself from the conversation.
- Do not harass or rush me to finish your commission. At any given time, I may have more than one commission and several things going on in my personal life. Just because I am online, does not mean that I am available to send you screenshots. You will be updated along the way. 
- I pride myself in having a quick and reasonable turn-around on commissions and am very open about delays, should they occur. However, if you need a commission completed by a certain date, this must be discussed before payment, as rush jobs may require additional fees. 
    - Before 1 week : 35% additional fee
    - 24 hours : 50% additional fee

Payment and Refunds
- All payments must be made in USD, paid in full upfront before I will begin your commission. I am willing to work with you on a payment plan, however, I will only do as much work as you have paid for, based upon my own interpretation. Payment plans must be discussed and agreed upon by both the client and myself.
- Payments must be made via PayPal by invoice.
- If you would like the source file included with your commission, you will be charged an additional 30% of the final asking price.
- If an invoice is not paid within 48 hours, you will lose your place in my current commission queue and will be placed to the back. 
- Refunds may be made on commissions that have yet to be completed or exceed a reasonable deadline by my standards. You will not receive a full refund on commissions that have been partially completed. If I have started the linework phase, you are subject to a 50% refund. If I have started the colouring phase, you are subject to a 25% refund. These numbers are subject to change depending on the amount of work that has been completed.
- I will not accept refunds because you, “Changed your mind” or “Did not budget correctly”. It is your responsibility to keep up with your own finances. If a cancellation is accepted, your refund will be issued when the funds are available, and you will receive the image that has been completed so far. All sales are final.
- I retain the right to refuse or accept any commission at any time in the process due to my own discretion. If I terminate a commission, I will refund you based on the completion of the project. 
- If you file a chargeback against me, your rights to the artwork will be retracted and I will automatically have the rights to resell your work to a new buyer or use it as personal work.

Use
    You may :
    - Crop a portion of your image to be used as an icon.
    - Post your commission on whichever social media / websites you’d like as long as you do not remove my signature and give credit. 
    - Resell my artwork if you are selling the character in it you have commissioned, ONLY. I also ask that you send me a DM and inform me of this decision, so I know not to question it.

    You may not :
    - Use work of mine that you have not commissioned.
    - Print your commission for sale of any kind. If you want to be able to redistribute the commission for sale, you must discuss it with me and pay for the rights.
    - Claim art as your own, modify it, trace it, etc.
    - Share or post a purchased source file for download / use. 
    - You are not allowed to remove my signature under any circumstances.
    - DO NOT edit and / or sell any image I have created. The only way you are allowed to sell my work is if you have purchased the rights to it or I have given you the okay to sell along with your character.

Retainment
I retain the rights to any and all images I create. I may use your commissioned piece for my own promotion at a later date, use it for prints, or otherwise as I see fit. If you wish to purchase the full rights to your commission, you must contact me so a negotiated price may be discussed. You are welcome to ask for a project to not be posted, but this must be discussed before I start.

Changes 
You will receive several WIP (work in progress) images throughout the commission process to ensure that you’re happy with it. Please be as thorough and detailed about changes as possible so as to make it easier on me as the artist. I will ask that the majority of revisions be made during the sketch phase, as this is the easiest phase to do them in. If your amount of revisions starts to become excessive, I retain the right to terminate the commission or charge you for the additional work and time you are requesting be put into the project. I try to keep this part of the process as reasonable and fair as possible and expect the same from you. You are responsible for giving me accurate reference material.
